Shaykh Abdul-Azeez ibn Baaz said:

What is the ruling on one who has the ability to give out Zakaatul Fitr but doesnt?
It is Waajib (compulsory) upon anyone who did not give out Zakaatul Fitr to repent to Allaah Azza wa Jal and ask Him for forgiveness because he has sinned due to withholding it. It is also Waajib upon him to give it out to those who deserve it and it is considered to be a Sadaqah (charity and not Zakaatul Fitr) when it is given after the Eed prayer.
Allaah is the granter of Success and may the Salaat and the Salaam be upon our Prophet Muhammad, his family and companions.
