Fasting and Praying in Scandinavian countries

Question: My sister and her husband currently live in Germany, she recently wrote to me asking me whether it is an obligation upon her and the Muslims there to fast the month of Ramadhan. She said: The sun remains risen (i.e. it is daytime) for 20 hours, and then the sun remains hidden (i.e. night-time) for 4 hours. So if fasting is an obligation upon them they will end up fasting 21.5 hours due to the fast starting with Dawn which is 1.5 hours before sunrise. Therefore they will only be breaking their fast for 2.5 hours.

Also what is the ruling of Salaah in such countries? And what do people do in those countries in which there is day for 6 months, and darkness for 6 months?

This is what we want to understand, perhaps we can succeed in a short amount of time by removing the difficulties that the citizens of those countries are facing by explaining to them the ruling of Allaah, facilitating their situation and clarifying the easiness of the religion.

Response: We looked at the question which is specific to those countries in which there is lack of sun for six month or so.

The Fuqahaa differed whether the Prayer is obligatory or not for the residents in such countries.

Some of them said: The Prayer is not an obligation upon them, this is due to the absence of the main indicator of the Prayer: [knowing] the time.

Others said: The Prayer remains an obligation, and they have to calculate the time for each Prayer basing it on the nearest country in which sunset and sunrise are clear on a daily basis. This last opinion was held by the Shaafiees, it is the correct opinion of the Hanafees, and this is what we have chosen as our Fatwa. This is in line with the wisdom behind the legislation of the Prayer.

As for the people of these countries fasting, it is an obligation upon them. They must base the beginning of the month and the period of fasting upon the nearest country wherein people have witnessed the beginning of the month, and they know the beginning and ending of the daily fast. This is also the opinion of the Shaafi’ees and we have chosen it for our Fatwa.

As for the countries in which the sunset and sunrise is clear but the sun remains risen [i.e. the day is] for twenty hours or more, they must pray each prayer in its correct time due to each time being clearly known.

As for fasting in Ramadhan, it is an obligation upon them from the break of dawn to sunset, except if fasting for this long will be a harm upon them, and they fear that fasting for so long is severely dangerous or can cause a severe illness, in this situation they are permitted to not fast. This should not be something which is merely assumed, rather it should be a strong probability based upon clear indicators, experience or a qualified doctor who affirm fasting in such a scenario will cause death, a severe illness, an increase in illness or a delay in cure [for an ill person]. This of course, differs from person to person, each individual will have a specific case.

Each person who did not fast in this situation will make up the fast at a later stage when the cause for this allowance has passed.

Allaah knows best and He is the one who guides.

صيام رمضان في شمال أوروبا

السؤال: تقيم كريمتي وزوجها الآن في ألمانيا، وقد كتبت إليَّ تستفهم عن الواجب عليها وعلى المسلمين هناك في شهر رمضان بالنسبة إلى الصيام حيث تقول: إن الشمس تستمر طالعة 20 ساعة، وتختفي أربع ساعات، فهل يلزمهم الصيام قبل طلوع الشمس بساعة ونصف وهو وقت طلوع الفجر وعلى ذلك فيصومون إحدى وعشرين ساعة ونصفًا ويفطرون ساعتين ونصفًا أم ماذا؟ وما حكم الصلاة أيضًا في هذه البلاد وكذلك في البلاد التي تستمر فيها الشمس طالعة نحو ستة أشهر وتغيب نحو ستة أشهر .

هذا ما نريد الاستفهام عنه فلعلنا نظفر في وقت قريب بما يزيل العقبات عن المقيمين في تلك البلاد ببيان حكم الله تعالى؛ تيسيرًا عليهم وتبيانًا لسماحة الدين؟

الجواب: اطلعنا على هذا السؤال ونفيد بأنه فيما يختص بالبلاد التي تغيب فيها الشمس ستة أشهر أو نحو ذلك

اختلف الفقهاء في وجوب الصلاة على المقيمين بها وعدم وجوبها:

فقال بعضهم: لا تجب عليهم الصلاة؛ لعدم وجود السبب وهو الوقت. وقال بعضهم: تجب عليهم الصلاة، وعليهم أن يقدروا لها أوقاتها بالقياس على أقرب البلاد التي تطلع فيها الشمس وتغرب كل يوم، والقول الأخير: قول الشافعية، وهو قول مصحح عند الحنفية، وهو الذي اخترناه للفتوى؛ مراعاة لحكمة تشريع الصلاة.

وفيما يختص بصوم أهل هذه البلاد فإنه واجب عليهم، وعليهم أن يتحروا عن دخول شهر رمضان وعن مدة الصيام فيه بالقياس على أقرب البلاد التي شهد أهلها الشهر، وعرفوا وقت الإمساك والإفطار فيه، وهو كذلك مذهب الشافعية الذي اخترناه للفتوى.

وأما البلاد التي تطلع فيها الشمس وتغرب كل يوم إلا أن مدة طلوعها تبلغ نحو عشرين ساعة، فبالنسبة للصلاة يجب عليهم أداؤها في أوقاتها؛ لتميزها تميزًا ظاهرًا. وبالنسبة للصوم يجب عليهم الصوم في رمضان من طلوع الفجر إلى غروب الشمس هناك، إلا إذا أدى الصوم إلى الضرر بالصائم وخاف من طول مدة الصوم الهلاك أو المرض الشديد فحينئذ يرخص له الفطر، ولا يعتبر في ذلك مجرد الوهم والخيال، وإنما المعتبر غلبة الظن بواسطة الأمارات أو التجربة أو إخبار الطبيب الحاذق بأن الصوم

يفضي إلى الهلاك أو المرض الشديد أو زيادة المرض أو بطء البرء، وذلك يختلف باختلاف الأشخاص، فلكل شخص حالة خاصة.

وعلى من أفطر في كل هذه الأحوال قضاء ما أفطره بعد زوال العذر الذي رخص له من أجله الفطر. والله تعالى أعلم.
