Performing Hajj on behalf of my Parents

Reference: Fataawa of The Permanenet Committee for Islamic Research & Verdicts – Fatwa Number 1375

Question: Can I make Hajj upon my parents who died and did not make Hajj during their lifetimes as it never became Waajib (obligatory) for them due to their poverty? I want the Islamic ruling in this regard.

Response: It is permissible for you to perform Hajj for your parents or to get someone else to do it for them, with the condition that you or the person who does the hajj, has performed it for themselves first, based upon what has been collected by Imaam Abu Daawood in his Sunan, on the authority of Abdullah ibn Abbaas, May Allaah be pleased with him, that the Prophet, May the peace and blessings of Allaah be upon him, heard a man say:

“Labbaika An Shubramah” (a pronouncement of Hajj on behalf of Shubramah).

He was asked “Who is Shubramah?”

And he replied “My brother or relative.”

He [the prophet, May the peace and blessings of Allaah be upon him] then said:

«Have you made Hajj yourself yet?»

And he replied “No.”

[So the Messenger of Allaah, May the peace and blessings of Allaah be upon him] said:

«Make Hajj for yourself and then upon Shubramah.»

This hadeeth is Authentic and there isn’t in this topic a hadeeth more authentic.

And with Allaah is Tawfeeq, and may the peace and blessings of Allaah be upon our prophet Muhammad, his family and his companions.

أداء فريضة الحج عن والديّ

السؤال: هل أحج عن والديَّ اللذين ماتا ولم تجب عليهما فريضة الحج لفقرهما، إلا أني أردت الحج؟ ولذا أريد حكم الشرع فيه.

الجواب: يجوز لك أن تحج عن والديك بنفسك، أو تنيب من يحج عنهما إذا كنت أنت حججت عن نفسك، أو كان الشخص الذي يحج عنهما قد حج عن نفسه؛ لما روى أبو داود في سننه عن عبد الله بن عباس رضي الله عنهما، أن النبي صلى الله عليه وسلم « سمع رجلًا يقول: لبيك عن شبرمة، قال: “من شبرمة؟ ” قال: أخ لي، أو قريب لي، قال: “حججت عن نفسك؟” قال: لا، قال: “حج عن نفسك، ثم حج عن شبرمة » وأخرجه ابن ماجه قال البيهقي : هذا إسناد صحيح، ليس في الباب أصح منه.
