Legally shortening the Hajj

Reference: ad-Durar an-Naadhirah fil-Fataawa al-Mu’aasirah – Page 418

Question: When the hajj pilgrim decides to [legally] shorten his hajj [by stoning the jamaraat pillars on the 11th and 12th days of Dhul-Hijjah and abstaining on the 13th day], but is unable to depart from Minaa before sunest after having [earlier] stoned the jamaraat pillars [before sunest], is he then required to remain in Minaa for the 13th day [of Dhul-Hijjah] or is he permitted to leave [Minaa even] after sunset?

Response: If the hajj pilgrim did not leave Minaa before sunset [having stoned the jamaraat pillars on the 12th day of Dhul-Hijjah], then he is required to remain the night in Minaa. He is then required to stone all three jamaraat pillars after the zawaal [which is when the sun above is at its highest point casting no shadow] on the 13th day of Dhul-Hijjah. This is because it is a condition for the one who decides to [legally] shorten his hajj [by stoning the jamaraat pillars on the 11th and 12th days of Dhul-Hijjah and abstaining on the 13th day] – that he depart from Minaa before sunset on the 12th day [of Dhul-Hijjah].

 


التعجيل في الحج

السؤال: إذا تعجل الحاج فرمى الجمرات لكنه لم يتمكن من الخروج من منى قبل غروب الشمس هل يبقى إلى اليوم الثالث عشر أم يخرج بعد الغروب؟

الجواب: الحاج إذا غربت عليه الشمس ليلة الثالث عشر من ذي الحجة قبل رحيله من منى فإنه يلزمه المبيت، و رمي الجمرات الثلاث بع الزوال من اليوم الثالث عشر، لأنه يشترط للتعجيل الرحيل من منى قبل غروب الشمس في اليوم الثاني عشر.
