Public demonstrations in the seasons of Hajj in Mecca

Praise be to Allah, and peace and blessings of Allah be upon His Messenger Muhammad bin Abdullah, and his family and his companions, and those who are guided by their guidance.

To proceed:

Allah has commanded the believing slaves to ‘free oneself and disassociate oneself’ from the idolaters at all times, and He revealed this in His, the Almighty’s, Saying in Surat al-Mumtahanah: 04

{Indeed there has been an excellent example for you in Ibrahim (Abraham) and those with him, when they said to their people: “Verily, we are free from you and whatever you worship besides Allah, we have rejected you, and there has started between us and you, hostility and hatred for ever, until you believe in Allah Alone,”}

And He sent down in regards to that, glory to Him, in the last part of the life of the Prophet, peace be upon him, His, the Almighty, saying in the Soorah of al-Tawbah: 01

{Freedom from obligation (is proclaimed) from Allah and His messenger toward those of the idolaters with whom ye made a treaty…} [the rest of the verses.]

…that Hadeeths are authentic to the Messenger of Allaah, peace and blessings be upon him, that he sent [Abu Bakr] as-Siddeeq, May Allaah be pleased with him, the ninth year after the migration to establish the rights of hajj for the people and to announce the disassociation from the Idolators, then he followed up that with Ali may Allah be pleased with him, to also convey that to the people. [Abu Bakr] as-Siddeeq, may Allah be pleased with him, sent two announcers (mueth.thin) with Ali, may Allah be pleased with him, calling people to four words: “None enters Paradise except a believing person, no idolators are allowed to perform Hajj after this year, none is allowed to make ‘Tawaaf’ of the House (Ka’bah) naked, and whoever had a contract with the Messenger of Allah then postpone it to its prescribed time, and whoever did not have a contract, then he has four months to travel the land, as the Almighty said in Surat Tawbah: 01

{Travel freely in the land four months, and know that ye cannot escape Allah and that Allah will disgrace the disbelievers.}

After that, the Prophet ordered the fighting of the Idolators if they did not accept Islaam, as Allah said in Soorah al-Tawbah: 05

{Then when the Sacred Months have passed…} i.e. the four months that the Messenger of Allaah postponed, according to the strongest of the two opinions of the people of knowledge in the explanation of this Aayah. Soorah al-Tawbah: 05

{Slay the idolaters wherever ye find them, and take them (captive), and besiege them, and prepare for them each ambush. But if they repent and establish worship (Salaah) and pay the poor-due (Zakaat), then leave their way free. Lo! Allah is Oft-Forgiving, Most Merciful.}

That is what is legislated in the affair of disassociation. This is what the Hadeeths from the Prophet, may the peace and blessings of Allaah be upon him, clarify, and the scholars of Tafseer of the Qur’aan (explainers of the Qu’aan) also clarify in the explanation of the beginning of Soorah al-Tawbah.

As for establishing mass marches and demonstrations in the seasons of Hajj in Mecca or other in order to pronounce and declare their disassociation from the idolaters, then that is an innovation, it has not basis in the religion, and the consequence from it is a significant amount of corruption and great evil. It s obligatory on each person who used to do this to leave it, and it is obligatory for the government (May Allah give them Tawfeeq) to prevent it and stop it. This is due to it being an innovation that has no basis in Islaam in the pure Islamic legal system, and also due to the various types of corruption, evil and harm that afflicts the pilgrims and others as a result of it. Allaah said in his book in Soorah Ali Imraan: 31

{Say, (O Muhammad, to mankind): If ye love Allah, follow me; Allah will love you}

And this action was not from the way of the Messenger of Allaah, or from the way of his companions, and if there was any good in it, they would have done it before us. He, the Sublime, said in Soorah al-Shoorah: 21

{Or have they partners (of Allah) who have made lawful for them in religion that which Allah allowed not?}

And He said in Soorah al-Hashr: 07

{And whatsoever the messenger giveth you, take it. And whatsoever he forbiddeth, abstain (from it).}

The Messenger, may the peace and blessings be upon him, said:

«Whoever introduces in our affair that which is not from it will be rejected» – [The scholars are] agreed upon its authenticity.

And he also said in an authentic Hadeeth narrated upon Jaabir in a Jumu’ah Sermon,

To proceed, the best of speech is the book of Allah and the best guidance is the guidance of Muhammad, may the peace and blessings be upon him, and the most evil of affairs are the newly invented matters, and every innovation is misguidance.

He also said:

«Take from me your rights of Hajj»

He never did any of these marches or protests during his farewell pilgrimage. Neither did his companions after him, may Allaah be pleased with them. So therefore, the implementation of such a thing during the Hajj season is an example of the innovations in the religion that the Prophet warned us from. This was only done by him, may the peace and blessings of Allaah be upon him, after the revelation of Soorah al-Tawbah, and he sent two announcers during the ninth year of Hijrah to convey to the people that no idolator can make hajj after the ninth year of Hijrah, none can make Tawaaf [of the Ka’bah] naked, none enters paradise except a believing person, and the cancellation of any agreements with the idolators after four months except an agreement for after four months, so those agreements will be until its agreed time. He, may the peace and blessings of Allaah be upon him, never made this announcement during his farewell pilgrimage due to the fact that the intent had been achieved during the announcement made in the ninth year of Hijrah.

All good and happiness in this world and the hereafter is in the following of the Prophet,may the peace and blessings of Allaah be upon him, by walking upon his path (his Sunnah), and by following the way of his companions, because they are the saved sect, and the aided group, them and the ones who followed them in good, as Allaah said in Soorah al-Tawbah: 100

{And the first to lead the way, of the Muhajirin and the Ansar, and those who followed them in goodness – Allah is well pleased with them and they are well pleased with Him, and He hath made ready for them Gardens underneath which rivers flow, wherein they will abide forever. That is the supreme triumph.}

Allaah is the One we ask to give us Tawfeeq, and to all the Muslims to gain beneficial knowledge, and righteous actions, to have a good understanding of the religion and the ability to walk upon the methodology of the Leader of the Messengers, his companions and those who follow them upon good until the last day. We ask Him to protect us and all the Muslims from deceptive trials that mislead [the people], from the incitements to evil from Shaytaan and from innovations in the religion. Verily He is the one Patron of that and the One who is able to do it.

May the peace and blessings of Allaah be upon His slave and messenger Muhammad, his family and companions.

القيام بالمسيرات في مواسم الحج في مكة المكرمة

الحمد لله , وصلى الله وسلم على رسوله محمد بن عبد الله , وعلى آله وصحابته , ومن اهتدى بهداه , أما بعد:

فإن الله أوجب على عباده المؤمنين البراءة من المشركين في كل وقت , وأنزل في ذلك قوله سبحانه : سورة الممتحنة الآية 4 قَدْ كَانَتْ لَكُمْ أُسْوَةٌ حَسَنَةٌ فِي إِبْرَاهِيمَ وَالَّذِينَ مَعَهُ إِذْ قَالُوا لِقَوْمِهِمْ إِنَّا بُرَآءُ مِنْكُمْ وَمِمَّا تَعْبُدُونَ مِنْ دُونِ اللَّهِ كَفَرْنَا بِكُمْ وَبَدَا بَيْنَنَا وَبَيْنَكُمُ الْعَدَاوَةُ وَالْبَغْضَاءُ أَبَدًا حَتَّى تُؤْمِنُوا بِاللَّهِ وَحْدَهُ

وأنزل في ذلك سبحانه في آخر حياة النبي صلى الله عليه وسلم قوله عز وجل : سورة التوبة الآية 1 بَرَاءَةٌ مِنَ اللَّهِ وَرَسُولِهِ إِلَى الَّذِينَ عَاهَدْتُمْ مِنَ الْمُشْرِكِينَ الآيات.

وصحت الأحاديث عن رسول الله صلى الله عليه وسلم أنه بعث الصديق رضي الله عنه عام تسع من الهجرة يقيم للناس حجهم ويعلن البراءة من المشركين ، ثم أتبعه بعلي رضي الله عنه ليبلغ الناس ذلك ، وبعث الصديق رضي الله عنه مؤذنين مع علي رضي الله عنه ينادون في الناس بكلمات أربع: لا يدخل الجنة إلا نفس مؤمنة ، ولا يحج بعد هذا العام مشرك ، ولا يطوف بالبيت عريان ، ومن كان له عند رسول الله عهد فأجله إلى مدته ، ومن لم يكن له عهد فله أربعة أشهر يسيح في الأرض كما قال عز وجل : سورة التوبة الآية 2 فَسِيحُوا فِي الْأَرْضِ أَرْبَعَةَ أَشْهُرٍ الآية.

وبعدها أمر النبي صلى الله عليه وسلم بقتال المشركين إذا لم يسلموا , كما قال الله عز وجل في سورة التوبة : سورة التوبة الآية 5 فَإِذَا انْسَلَخَ الْأَشْهُرُ الْحُرُمُ يعني : الأربعة التي أجلها لهم عليه الصلاة والسلام في أصح قولي أهل العلم في تفسير الأشهر المذكورة في هذه الآية . سورة التوبة الآية 5 فَاقْتُلُوا الْمُشْرِكِينَ حَيْثُ وَجَدْتُمُوهُمْ وَخُذُوهُمْ وَاحْصُرُوهُمْ وَاقْعُدُوا لَهُمْ كُلَّ مَرْصَدٍ فَإِنْ تَابُوا وَأَقَامُوا الصَّلَاةَ وَآتَوُا الزَّكَاةَ فَخَلُّوا سَبِيلَهُمْ إِنَّ اللَّهَ غَفُورٌ رَحِيمٌ

هذا هو المشروع في أمر البراءة , وهو الذي أوضحته الأحاديث عن النبي صلى الله عليه وسلم , وبينه علماء التفسير في أول تفسير سوره براءة : ( التوبة).

أما القيام بالمسيرات والمظاهرات في مواسم الحج في مكة المكرمة أو غيرها ؛ لإعلان البراءة من المشركين فذلك بدعة لا أصل لها , ويترتب عليه فساد كبير وشر عظيم , فالواجب على كل من كان يفعله تركه , والواجب على الدولة وفقها الله منعه; لكونه بدعة لا أساس لها في الشرع المطهر , ولما يترتب على ذلك من أنواع الفساد والشر والأذى للحجيج وغيرهم , والله سبحانه يقول في كتابه الكريم : سورة آل عمران الآية 31 قُلْ إِنْ كُنْتُمْ تُحِبُّونَ اللَّهَ فَاتَّبِعُونِي يُحْبِبْكُمُ اللَّهُ الآية , ولم يكن هذا العمل من سيرته عليه الصلاة والسلام , ولا من سيرة أصحابه رضي الله عنهم , ولو كان خيرا لسبقونا إليه , وقال سبحانه : سورة الشورى الآية 21 أَمْ لَهُمْ شُرَكَاءُ شَرَعُوا لَهُمْ مِنَ الدِّينِ مَا لَمْ يَأْذَنْ بِهِ اللَّهُ وقال عز وجل : سورة الحشر الآية 7 وَمَا آتَاكُمُ الرَّسُولُ فَخُذُوهُ وَمَا نَهَاكُمْ عَنْهُ فَانْتَهُوا

وقال الرسول صلى الله عليه وسلم : صحيح البخاري الصلح (2550),صحيح مسلم الأقضية (1718),سنن أبو داود السنة (4606),سنن ابن ماجه المقدمة (14),مسند أحمد بن حنبل (6/270). من أحدث في أمرنا هذا ما ليس منه فهو رد متفق على صحته , وقال عليه الصلاة والسلام في الحديث الصحيح عن جابر رضي الله عنه في خطبة الجمعة : صحيح مسلم الجمعة (867),سنن النسائي صلاة العيدين (1578),سنن أبو داود الخراج والإمارة والفيء (2954),سنن ابن ماجه المقدمة (45),مسند أحمد بن حنبل (3/311),سنن الدارمي المقدمة (206). أما بعد ، فإن خير الحديث كتاب الله ، وخير الهدي هدي محمد صلى الله عليه وسلم ، وشر الأمور محدثاتها ، وكل بدعة ضلالة . أخرجه مسلم في صحيحه , وقال عليه الصلاة والسلام : صحيح مسلم الأقضية (1718),مسند أحمد بن حنبل (6/256). من عمل عملا ليس عليه أمرنا فهو رد . أخرجه مسلم أيضا , وقال صلى الله عليه وسلم في حجة الوداع : سنن النسائي مناسك الحج (3062). خذوا عني مناسككم ، ولم يفعل صلى الله عليه وسلم مسيرات ولا مظاهرات في حجة الوداع , وهكذا أصحابه بعده رضي الله عنهم , فيكون إحداث ذلك في موسم الحج : من البدع في الدين التي حذر منها النبي صلى الله عليه وسلم , وإنما الذي فعله عليه الصلاة والسلام بعد نزول سورة التوبة : هو بعث المنادين في عام تسعة من الهجرة; ليبلغوا الناس : أنه لا يحج بعد هذا العام – يعني : عام تسع – مشرك , ولا يطوف بالبيت عريان , وأنه لا يدخل الجنة إلا نفس مؤمنة , مع نبذ العهود التي للمشركين بعد أربعة أشهر إلا من كان له عهد أكثر من ذلك فهو إلى مدته , ولم يفعل صلى الله عليه وسلم هذا التأذين في حجة الوداع; لحصول المقصود بما أمر به من التأذين في عام تسع.

والخير كله , والسعادة في الدنيا والآخرة في اتباع النبي صلى الله عليه وسلم , والسير على سنته , وسلوك مسلك أصحابه رضي الله عنهم; لأنهم الفرقة الناجية والطائفة المنصورة , هم وأتباعهم بإحسان , كما قال الله عز وجل : سورة التوبة الآية 100 وَالسَّابِقُونَ الْأَوَّلُونَ مِنَ الْمُهَاجِرِينَ وَالْأَنْصَارِ وَالَّذِينَ اتَّبَعُوهُمْ بِإِحْسَانٍ رَضِيَ اللَّهُ عَنْهُمْ وَرَضُوا عَنْهُ وَأَعَدَّ لَهُمْ جَنَّاتٍ تَجْرِي تَحْتَهَا الْأَنْهَارُ خَالِدِينَ فِيهَا أَبَدًا ذَلِكَ الْفَوْزُ الْعَظِيمُ

والله المسئول أن يوفقنا وجميع المسلمين للعلم النافع , والعمل الصالح , والفقه في الدين , والسير على منهج سيد المرسلين وأصحابه المرضيين , وأتباعهم بإحسان إلى يوم الدين , وأن يعيذنا وجميع المسلمين من مضلات الفتن , ونزغات الشيطان , ومن البدع في الدين , إنه ولي ذلك والقادر عليه . وصلى الله وسلم على عبده ورسوله محمد , وآله وصحبه.
